Yes, it has had plenty of time to work and to the best of my knowledge nobody has ever seen any of their reports on their credit reports. I see that they have updated their domain registry for another year but that isn't really very meaningful.

I now say it that if it isn't Scam it is his brother.

I'm in California.
I have four credit cards which I stopped payment on, on or before March '98.

I've only recently requested the credit reports. 1) Do I have the right to question my credit report accuracy at any time, or just 30 or 60 days after it's sent.
You have the right to question the accuracy of any item on your credit report at any time.


The CRA's (over the phone and on forms) seem to only allow me to dispute, not request verification of debt. 2)Should I request a VOD in writing from the CRA's? (I don't want to dispute reports that are actually mine and appear correct, right?)

You cannot demand validation of debt from a credit bureau. The thing that folks need to understand is that there is a big difference between validation and verification. Validation of debt can be demanded of creditors and 3rd party debt collectors while verification can be demanded of credit bureaus.
Verification is a much lower standard of proof by a long way.

3) Do they have a time limit to answer if they've already been sending me payment requests for years?
3rd party debt collectors are never under the gun for any time limit in which they must comply with demand for validation. If you want them to be under some kind of time limit you have to impose it on them. That is why you must have a plan of action that works and gets some kind of resolution to the problem or you might sit there forever or until they sue you. If you sit there and wait until they finally decide to sue you then you will be in very bad shape indeed if you do not have a solid plan of action resulting in either a defense or an offensive lawsuit which you file against them. That is what CREDITWRENCH does for you. It teaches you how to build a defense in case they sue you or a good case if you want to sue them.


Equifax lists Date of Last Activity (one incorrect), but not Date of Last Payment (or date of first default);

TransUnion lists "estimated date that this item will be removed", and they seem accurate, but no dates of first defaults, etc.

Experian lists "Date of Status", all of which are later than reality for date of first default or date of last activity:

You have to dispute with each bureau separately.

Experian has comingled my credit report with my Fathers'.
4) Should I dispute the accounts in good standing that aren't mine?
Both of you need to dispute separately.

As these all should come off my credit report within 6 to 14 months, and have been uncollectible for years,

(5) is there a benefit to my negotiating a payment in full with the present owners of the debt? With the original creditors?

There is a great benefit to negotiating a payment in full with the present owners of the debt. It means that you will definitely cement them on your credit reports for the full period of time and maybe even longer than that.

Then if you pay them you lose the benefit of the fact that you won't have the opportunity to beat them in court and you will have the benefit of paying for a debt you don't even owe anymore because the debts are obviously well beyond the statute of limitations.

Don't pay them a crying dime. You only lose if you do.

Dispelling 75% of the myths that haunt most other boards surrouncing validation of debts, validation letters, what they do and what they are supposed to do is only the tip of a very big iceberg. If I could reach even 25% of the people who believe the false information and scams out there I'd be doing some real good.

Yes, there is but it may not be easy.
The way you are approaching this situation is by trying to prove you don't owe the money they claim you owe but that is not the way to get the job done if they don't want to listen to you.

When you are contacted by a collection agency you always need to take the approach of making them prove that you owe the debt they claim rather than trying to prove that you don't.

In the end you may have to sue them so you need to learn all of the possible FFCPA violations they might commit or might have committed. The best way to do that is to use our litigation support checklist which is available only to creditwrench students.
